LONGMONT, Colo. (AP) — Longmont is continuing its legal battle to ban fracking.
The Times-Call (https://bit.ly/1wAn4rV) reports that city councilors voted unanimously Tuesday night to appeal a state judge’s ruling against its ban on hydraulic fracturing. They also invited other cities with similar bans to join them.
Voters passed the ban in 2012 and it was challenged in court by state regulators and the oil and gas industry. In July, District Court Judge D.D. Mallard ruled that the ban conflicted with existing state law and changing that was up to either the Legislature or a different court.
The state also challenged drilling regulations passed by the city but has dropped that lawsuit as part of a compromise to keep drilling measures off November’s ballot.
The fracking ban will remain in place during the appeal.
