SPOKANE, Wash. (AP) - A Spokane plumber on trial for manslaughter says the only thing he did wrong was mistake keys for a gun when he shot a man who was driving away with the plumber’s vehicle.
Gail Gerlach contends he thought the man was holding a gun, but no weapon was found.
The Spokesman-Review reported that Gerlach testified on Wednesday as his defense wrapped up its case in Spokane County Superior Court.
Brendon Kaluza-Graham was shot through the tinted back window of the SUV as he drove away with Gerlach’s vehicle the morning of March 25, 2013. He was struck in the head and died almost immediately.
Gerlach has been charged with first-degree manslaughter and faces up to a decade in prison if convicted.
