HOPKINS, Mo. (AP) - A northwest Missouri prosecutor says he will not file criminal charges against a man who shot and killed his nephew during a domestic disturbance.
Nodaway County Prosecuting Attorney Robert Rice said Thursday that 51-year-old Lewis Schrodt was legally defending himself when he shot 34-year-old Mickey Lobdell of Kansas City at a home near Hopkins last December.
The St. Joseph News-Press reports (https://bit.ly/1hIlESL ) investigators determined Schrodt fired two warning shots before shooting Lobdell, who was threatening him and other family members.
Rice said Schrodt was not physically capable of defending himself against Lobdell.
