ALBUQUERQUE, N.M. (AP) - A fugitive accused of pulling a gun on a federal marshal in Albuquerque last week has been captured.

The U.S. Marshals Service says Rufus Phelps was arrested Thursday after members of a law enforcement task force developed leads that he was parked near the University of New Mexico. He was waiting for his pizza to be delivered.

Agents confirmed it was Phelps, moved in and took him into custody without incident.



Deputy marshals attempted to arrest Phelps last week on a bench warrant from September 2013. Phelps allegedly pulled out a gun, a marshal then fired a shot and the fugitive fled.

A grand jury indicted Phelps last year on several drug-related charges, aggravated assault with a deadly weapon and aggravated assault against a household member.
