WINSTON-SALEM, N.C. (AP) - A judge has declared a mistrial in the case of a Kernersville man accused of passing a stopped school bus and killing the sixth-grader crossing the road trying to catch it.
The Winston-Salem Journal reports (https://bit.ly/1tDFTXf) the trial of Billy Roger Bailey ended Wednesday when Judge Ronald Spivey approved a joint motion by prosecutors and Bailey’s attorneys for a mistrial based on newly discovered evidence. The case will have to be re-tried.
State troopers said 11-year-old Hasani Wesley missed his bus for East Forsyth Middle School on Dec. 19, 2012. The bus turned around and headed in the opposite direction. Hasani was crossing a road to reach it when he was hit.
The bus driver said her lights were flashing and the arm was out to warn motorists to stop.
